In Pennsylvania, sole proprietors who have no employees are generally exempt from the requirement to carry workers' compensation insurance. The requirement is triggered by having one or more employees — a sole proprietor working alone is not required to cover themselves.

The PA Sole Proprietor Exemption: What Triggers Coverage and When to Elect It Voluntarily

The exemption applies only when the sole proprietor truly has no employees. The moment a sole proprietor hires even one part-time employee, the workers' comp requirement is triggered for that employee (and optionally for the proprietor themselves).

Sole proprietors may voluntarily elect to cover themselves under a workers' comp policy — this can provide valuable medical and disability protection for the owner if injured. However, it is not legally required.

The sole proprietor exemption is distinct from independent contractor status. A sole proprietor who works for another business as a subcontractor may still be treated as that business's employee for workers' comp purposes unless they carry their own coverage.
